Obtaining Your Restricted License After 2nd DUI Conviction

At your sentencing on a 2nd DUI, the judge will order you to complete a number of penalties such as performing community service/labor, an 18 month DUI program, or attend a MADD Victims Impact Panel. Each of these terms of your 2nd DUI probation requires transportation. Ride services and taxis are not financially feasible for most of us and depending on friends or family members is a short term option at best. You can, however, obtain a restricted license after 2nd DUI once you are eligible and meet the criteria set forth by the California DMV. A sentence for a 2nd DUI conviction is difficult. However, a restricted license makes the transition much more manageable.

Eligibility For Restricted License

Assuming you were not convicted of a 2nd offense DUI Refusal, which in that case you would be ineligible for restricted driving, your eligibility would begin after completing the first 90 days of your 2-year suspension. Also known as the “Hard Suspension,” this is the period of suspension when you are prohibited from driving. After you successfully complete this step, you must arrange for the following:

  • Obtain an SR 22 from your insurance broker or agent and have it filed with DMV
  • Have your 2nd offender DUI program file your proof of enrollment with DMV
  • Have an Ignition Interlock Device or IID installed in your vehicle

It is important to note the IID requirement on 1st offense DUI convictions only applies to convictions in Los Angeles County. However, 2nd offense DUI convictions in each county throughout Southern California allow for restricted driving after 90 days of hard suspension. Once you have completed each of the steps mentioned above, you can visit your local DMV field office to apply for your restricted license.
