California Penal Code 422(a) defines the crime of Criminal Threats as the willful act of threatening, whether in-person, by telephone, or by any other form of electronic communication, to commit a crime which will result in death or great bodily injury to another person with the specific intent that the statement is to be taken as a threat.
How Proposition 36 Revises California’s Three-Strikes Law California’s three-strikes law was passed in 1994. From the beginning, the unjust statute stirred tremendous controversy. While its intent was to incarcerate violent criminals, it resulted in putting nonviolent offenders behind bars for life, often for minor crimes. Voters overwhelmingly passed Proposition 36 in November 2012 to correct the injustice inherent in the original three-strikes law.
